📕 Poteau Terms of Use

These terms govern your use of the Poteau app. By creating an account, you accept them.
How we process your personal data is described in a separate document, the Privacy Policy, which forms an integral part of these terms.
1. Who we are
Poteau is published by Krank, a SAS (French simplified joint-stock company) with share capital of €4,910.60, registered with the Paris Trade and Companies Register (RCS), SIREN 809 684 533, with its registered office at 18 bis rue d'Anjou, 75008 Paris.

2. What Poteau is, and what it is not
Poteau is a platform that connects people. It lets players find games, organize them, and meet up on a pitch.
Poteau does not organize games and is not responsible for them. Each game is organized by a user or by a partner sports centre. We are not a party to the game, we do not guarantee that it will take place, and we have no control over how it goes.
This distinction matters, and it determines the responsibilities described below.
3. Your account
3.1 Sign-up requirements
You must be at least 16 years old to create an account.
You agree to provide accurate information and to keep it up to date. An account is personal: you cannot lend it, share it or transfer it.
3.2 Security
You are responsible for keeping your login details confidential and for the actions taken from your account. If you think it has been compromised, tell us immediately.
3.3 Deletion
You can delete your account at any time from the app's settings. The effects of deletion are described in the Privacy Policy.
4. Organizing a game
When you create a game, you commit to several things.
4.1 You certify that you have access to the pitch
A game existing on Poteau does not count as a booking. Whether on a public pitch or in a private centre, booking remains entirely your responsibility. Poteau books nothing for you and checks nothing.
If the pitch is not available on the day, that is your responsibility towards the players you brought together.
4.2 You are responsible for the information you publish
The place, the time, the price, the level, the number of spots: everything must be accurate. The price shown must match the price actually charged.
4.3 You are responsible for how the game goes
You are responsible for running the game and for any incidents that may occur during it. We strongly recommend that you check you are covered by civil liability insurance.
4.4 You commit to the players
Cancelling a game that players have signed up for is not a neutral act. Do it as early as possible and let them know in the game's conversation.
5. Taking part in a game
By signing up for a game, you commit to coming.
Withdrawing is possible and normal. Withdrawing at the last minute leaves a gap in the team and can stop the game from taking place. The rules below exist for this reason.
5.1 Your number is visible
The other participants in a game see your phone number, so that they can reach you on game day. This is how the service normally works.
5.2 Behaviour
You agree to behave properly, in the app as on the pitch. The following are prohibited in particular: insults, harassment, discriminatory remarks, violence, promoting competing services in conversations, and using the app for unauthorised commercial purposes.
6. Payments
6.1 Two scenarios
Payment on site: you pay the organizer or the centre directly. Poteau is not involved.
Payment in the app: offered on some games organized by partner centres.
6.2 How payment in the app works
Sign-ups open 7 days before the game.
When you sign up, a payment authorisation is placed on your card. This is not a charge: the amount is reserved, not debited.
The actual charge happens 1 hour before the game starts, and only if the game takes place. If the game is cancelled, the authorisation is released and you are charged nothing.
If you change the number of spots booked, the previous authorisation is cancelled and replaced with a new one.
Your bank details are processed by Stripe and never pass through our servers.
6.3 Withdrawal and refund
More than 3 hours before the game: free withdrawal, no fee.
Between 3 hours and 1 hour before the game, if the game is full or nearly full: a fee of €4 applies. It compensates the harm caused to the organizer and the other players.
After the charge, that is less than one hour before: no refund.
6.4 Right of withdrawal
In accordance with article L221-28 of the Code de la consommation (French Consumer Code), the 14-day right of withdrawal does not apply to leisure services provided on a specific date. By signing up for a game, you agree that the service will be performed on the scheduled date and you waive this right for that booking.
This waiver does not concern the Gold subscription, covered in article 7.
7. Poteau Gold subscription
7.1 What it includes
The Gold subscription gives access to exclusive benefits, in particular a reliability badge on your profile, early access to certain features, and a €0.50 discount on games paid in the app.
7.2 Billing and renewal
The subscription is renewed automatically at the end of each period. It is billed by Apple or Google depending on your phone, and not directly by Poteau.
7.3 Cancellation
You can cancel at any time from your Apple or Google account settings, no later than 24 hours before the end of the current period. You keep the benefits until the end of the period already paid for.
7.4 Withdrawal
For a subscription taken out remotely, you have a 14-day withdrawal period. Refund requests are handled by Apple or Google, who collect the payment. Write to us if you run into any difficulty and we will help you through the process.
8. Rules of conduct and sanctions
8.1 What can lead to a sanction
Not showing up to a game without warning.
Repeatedly withdrawing late.
Abusive behaviour towards another user.
Providing false information about a game.
Creating several accounts to get around a sanction.
8.2 Possible sanctions
Depending on severity and repetition: a warning, a yellow card, a red card leading to a temporary suspension, or permanent closure of the account.
8.3 How they are decided
A report from another user can never, on its own, lead to an automatic sanction. Reports alert our team, who look into the situation.
Only one sanction is automatic: the red card for repeated late withdrawal, because our servers measure the timing themselves and this measurement cannot be manipulated.
8.4 Contesting
Any sanction can be contested at contact@poteau.team. A member of the team will review your case.
9. Content you publish
You remain the owner of the photos and messages you publish. You grant us the right to host and display them in the app, only to the extent necessary for the service to work.
You guarantee that you hold the rights to what you publish, and that it does not harm anyone.
We may remove content that is clearly unlawful or contrary to these terms. You can report content to us at contact@poteau.team, and we will keep you informed of the action taken.
10. Listed places
The places shown in the app come from Google Maps. We have no control over their content. Any request to add, correct or remove a place must be sent directly to Google.
11. Service availability
We do our best to keep the app running continuously, but cannot guarantee it. Interruptions may occur for maintenance or for reasons beyond our control.
We may change the app's features, and remove those that are no longer relevant.
12. Liability
Poteau is responsible for the proper functioning of the app itself.
Poteau is not responsible for:
whether a game actually takes place, its quality or its cancellation;
booking the pitch, which is the organizer's responsibility;
bodily injury or property damage occurring during a game;
how users behave towards one another;
the accuracy of information published by an organizer.
None of these limitations applies in the event of gross negligence or intentional misconduct on our part, nor in cases where French law prohibits limiting liability, in particular for bodily injury.
Nothing in these terms deprives a consumer of the rights guaranteed by law, in particular the legal guarantee of conformity.
13. Freedom of association
Poteau respects and supports the freedom to associate and to assemble peacefully, as guaranteed by French and European law.
14. Changes to the terms
We may update these terms. If there is a significant change, you will be notified in the app or by email at least 30 days before they take effect.
If you do not accept the new terms, you can delete your account before that date.
15. Governing law and disputes
These terms are governed by French law.
If there is a disagreement, write to us first at contact@poteau.team: most situations are resolved this way.
If we cannot find a solution, you can turn free of charge to a consumer mediator (médiateur de la consommation). In accordance with article L612-1 of the Code de la consommation (French Consumer Code):

Failing that, the French courts have jurisdiction. If you are a consumer, you can bring the matter before the court of your place of residence.
